1. Definitions

“Company”, “We”, “I”, “Our”, or “Us” means WholeFit Solutions LLC and wholefitsolutions.com.

“Content” means any and all written, visual, video, or audio information contained on the Site, including, but not limited to, any and all emails received from Kamber McCormick, WholeFit Solutions LLC or wholefitsolutions.com, and any and all written or downloadable material purchased, viewed, or otherwise offered on wholefitsolutions.com, such as blog posts, graphics, designs, documents, information, templates and materials or on demand workouts.

“Personal Information” means information that can be used on its own or in conjunction with other information to identify, contact, or locate a person, or to identify an individual in context. For example, personal information includes, among other things, your name, address, email address, telephone number, credit card information, site behavior, etc.

“Site, Courses, Services, and/or Products” means wholefitsolutions.com, Content, email list, social media posts, blog posts, courses, coaching services, guides, eBooks, forms, worksheets, workbooks, website materials, and/or on demand workouts available on the Site.

“Services” refers to the coaching, nutrition, and related programs, courses, and resources provided by WholeFit Solutions LLC.

“Site” or “Website” refers to wholefitsolutions.com and any and all of the Company’s associated pages, tabs, landing pages, forms, or sub-pages.

“You” or “Your” means the user, customer, or viewer of the Site.

The Site and its Content are owned by WholeFit Solutions LLC and/or Kamber McCormick.

WholeFit Solutions LLC is committed to protecting your Personal Information. We will only collect or use your Personal Information in accordance with the Privacy Policy herein.

3. What kind of Personal Information do we collect?

Personal Information You Provide:

When using the Site, and in filling out forms, purchasing products, providing comments, or contacting us, you may be asked to enter your name, email address, website address, mailing address, payment or credit card information. We use this information to deliver the product purchased, or information requested, to improve the performance and applicability of the Site, and to provide you with educational content, newsletters, promotions, and special offers.

Personal Information Automatically Collected:

Through use of the Site, the Company may use data collection technology, such as Google Analytics and/or Wix’s analytic tools and similar technologies (hereinafter referred to as the “Data Collection Companies”) to collect information related to your use of the Site. Generally speaking, this includes information about your approximate geographic location, browser type, device type, operating system, IP address, and how you interact with the Site (such as pages visited and time spent).

We collect this information for statistical purposes only and to improve the viewer experience.

4. What if the Personal Information we have about you is incorrect or you want to update it?

5. When do we collect Personal Information?

We collect Personal Information from you when you purchase, order, sign up for, or participate in our coaching programs, courses, services, or products. This may include completing an application or intake form, creating an account, downloading free resources, subscribing to our newsletter, or communicating with us through email, the Everfit coaching app, or other platforms used to deliver our services.

We may also collect information when you fill out forms, request information, or engage with content on our Site. If you are simply browsing the Site, you are not required to provide any Personal Information.

If you're outside of the EU: if you sign-up to receive any free resources, downloads, webinars, recordings, courses, or services from the Company, or by purchasing any products or services from us, you may be added to our email list to receive relevant updates, resources, and promotional content. You can unsubscribe at any time by clicking "UNSUBSCRIBE" at the bottom of each email. If you have any questions, or difficulty unsubscribing from those emails, email Kamber McCormick at kamber@wholefitsolutions.com to be unsubscribed from future messages.

If you're IN the EU: if you sign-up to receive any free resource, downloads, webinars, recordings, courses, or services from the Company, or by purchasing any products or services from us, you will only be added to our email list to receive free email messages from us if you affirmatively consent to receiving such messages. You can unsubscribe at any time by clicking "UNSUBSCRIBE" at the bottom of each email. 6. How do we use your Personal Information?

When using the Site, Programs, Courses, Services, and/or Products, we may use the Personal Information we collect from you when you register, make a purchase, complete an application or intake form, sign up for coaching, subscribe to our newsletter, respond to a survey or marketing communication, browse the Site, or use certain other Site features in the following ways:

To personalize your experience and deliver the type of content, program recommendations, or product offerings that best match your interest and goals.
To improve our Site, programs, and services in order to better serve you.
To communicate with you, provide customer support, or respond to inquiries.

To manage scheduling, coaching communications, and progress tracking within platforms such as Everfit or other client management systems.

7. Do we share your Personal Information with anyone?

In general, we DO NOT sell, trade, or otherwise transfer your Personal Information to outside (third) parties for their independent marketing purposes. We may share information with trusted third parties in the following limited circumstances.

Legal and Safety Requirements: To comply with applicable laws or respond to lawful requests from law enforcement, courts, or government authorities.
Service Providers: With third-party vendors that help us operate our business and deliver services, such as website hosting (Wix), email marketing tools, payment processors (e.g., Stripe), client management platforms (e.g., Everfit), analytics providers, or professional advisors. These providers are permitted to process Personal Information only as necessary to perform services on our behalf and are required to keep it confidential.
Social Media Integrations: When you use built-in functions to share content to social media platforms (e.g., Facebook, Instagram, Pinterest), information necessary to complete that action may be shared with those platforms according to their privacy policies.
Advertising and Analytics: We may share limited information with advertising or analytics partners (such as Facebook, Instagram, or Google) to understand user preferences, measure marketing performance, and deliver relevant advertisements. These companies may use cookies or similar technologies to collect information about your interactions with our Site or other websites.

It’s also important to note that we do allow third-party behavioral tracking (see Section 9 for additional information).

8. How do we protect your Personal Information?

WholeFit Solutions LLC aims to make your experience on our Site as safe and secure as possible. The Site is hosted by Wix, which provides secure hosting and automatically implements SSL (Secure Socket Layer) encryption to protect the transmission of information. You will see “https://” in the website address, indicating an encrypted connection.

Your Personal Information is stored behind secure networks and is accessible only to a limited number of authorized persons who have special access rights to such systems and are required to keep this information confidential.

We do not collect or store sensitive payment information directly on our Site. All payments are processed through secure, third-party providers such as Everfit and Stripe, which use industry-standard encryption and security protocols. Transactions are processed through these gateway providers and are not stored or processed on our servers.

While we use commercially reasonable methods to protect your information, no system can guarantee absolute security. By using our Site or participating in our programs, you acknowledge and accept the inherent risks associated with transmitting information online.

9. Do We Use Cookies or Social Media Pixels?

Cookies:

WholeFit Solutions LLC, and certain third parties described in this Policy (see Section 7), may use cookies and similar technologies to collect information from the computer, mobile phone, or other device you use to access the Site, read our emails, or view our content.

Cookies are small data files that a website transfers to your computer’s hard drive through your web browser (if you allow) that enable the site or service provider to recognize your browser and capture certain information. Wix, our hosting provider, uses cookies to help the Site function properly and to improve performance.

We use cookies to:

Help remember and process preferences or activity on the Site.
Compile aggregate data about Site traffic and interactions so that we can offer better experiences and tools in the future.
Understand visitor behavior and preferences for analytics and limited marketing purposes.

We may also use trusted third-party analytics tools, such as Google Analytics or Wix Analytics, that use cookies on our behalf.

We may use and share aggregated, anonymized, or de-identified data for statistical, research, or marketing purposes, provided that such information cannot reasonably identify any individual user.

Social Media Pixels:

At this time, WholeFit Solutions LLC does not use social-media tracking pixels (for example, Facebook Pixel or TikTok Pixel). However, we reserve the right to implement such tools in the future in accordance with the applicable terms and privacy policies of those platforms. If we do, these pixels will allow us to measure the effectiveness of advertising and better understand visitor interests while complying with all relevant privacy regulations.

10. Third-Party Links

Occasionally, at our discretion, we may include or offer links to third-party products, services, articles, or other websites through our Site. These third-party sites operate independently of WholeFit Solutions LLC and may have their own privacy policies or practices.

We are not responsible or liable for the content, security, or activities of these linked sites, nor for their privacy policies (or lack thereof). However, we seek to maintain the integrity of our Site and welcome feedback about any issues you experience with third-party links. 11. Google Ads and Analytics

WholeFit Solutions LLC uses Google Analytics to help us understand how visitors interact with our Site and to improve performance and user experience. Through Google Analytics, we may collect non-personally identifiable information such as demographics, interests, and general usage data.

We are not currently using Google Ads or remarketing features on our Site; however, we may do so in the future in accordance with Google’s Advertising Principles, which are designed to ensure a positive and transparent experience for users.

Google Analytics may use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) or other identifiers together to compile reports on user interactions, ad impressions, and other related functions. This helps us evaluate website traffic and effectiveness of content or campaigns.

Opt-Out Options:

You can manage how Google collects and uses information by visiting the Google Ad Settings page. You can also opt out of Google Analytics tracking by installing the Google Analytics Opt-Out Browser Add-On or visiting the Network Advertising Initiative Opt-Out page.

12. California Online Privacy Protection Act (“CalOPPA”)

CalOPPA requires any person or company operating a website that collects personally identifiable information from California consumers to post a conspicuous privacy policy stating exactly what information is collected and how it is shared. This law applies to businesses inside and outside California that have visitors from California.

Pursuant to CalOPPA, WholeFit Solutions LLC agrees to the following:

Users can visit our Site anonymously.
There is a clear and visible link to this Privacy Policy in the footer of our website.
The link includes the word “Privacy” and is labeled “Privacy Policy.”
Users will be notified of any changes to this Privacy Policy by checking the “Last Updated” date listed at the bottom of this page.

13. Children’s Online Privacy Protection Act (“COPPA”)

WholeFit Solutions LLC does not knowingly collect Personal Information from children under the age of 13 and does not specifically market to them. If you are under 13 years old, please do not use, view, purchase, or otherwise interact with the Site, courses, services, or products, and do not submit any Personal Information.

If you are a parent or guardian and believe that your child under the age of 13 has provided us with Personal Information, please contact us immediately at kamber@wholefitsolutions.com so that we can promptly delete the information from our records.

14. Fair Information Practices

WholeFit Solutions LLC follows the Fair Information Practice Principles, which form the basis of privacy law in the United States. In compliance with these principles, should a data breach occur that is likely to result in harm to your Personal Information, we will take the following responsive actions:

We will notify affected individuals via email within five (5) business days of becoming aware of the breach.
If email notification is not possible, we will use reasonable alternative methods to contact you, consistent with applicable law.
We will take immediate steps to investigate the issue, mitigate any potential harm, and prevent future occurrences.

15. CAN-SPAM Act of 2003

The CAN-SPAM Act is a U.S. law that establishes rules for commercial email, gives recipients the right to have emails stopped from being sent to them, and outlines penalties for violations.

WholeFit Solutions LLC collects your name and email address in order to:

Send information, respond to inquiries, and provide customer support.
Process orders and send information or updates related to purchased programs, products, or services.
Send additional information or resources related to your coaching program or other services.
Market to our email list or continue sending communications after a client relationship or transaction has occurred.
Email newsletters with free content, updates, and information about WholeFit Solutions programs, products, or services.

In accordance with the CAN-SPAM Act, we agree to the following:

We will not use false or misleading subject lines or email addresses.
We will identify the message as an advertisement or informational message when applicable.
We will include our valid business mailing address in each email.
We will monitor any third-party email marketing services for compliance. (We currently use MailerLite to send our email communications.)
We will honor opt-out and unsubscribe requests promptly.
We will provide clear instructions at the bottom of each email on how to unsubscribe.

If you wish to stop receiving future emails, you can click “Unsubscribe” at the bottom of any email or contact Kamber McCormick at kamber@wholefitsolutions.com. You will be promptly removed from the corresponding mailing list. Please note that unsubscribing from one list may not automatically remove you from all communications (for example, billing or program-specific emails). If you continue receiving unwanted emails, please contact us at the same email address and we will ensure full removal.

16. Your General Data Protection Regulation ("GDPR") Rights

If you are located within the European Union (“EU”) or another region that grants similar data protection rights, you are entitled to certain rights under the General Data Protection Regulation (“GDPR”). These include the right to:

Access and Rectification: Request access to the personal information we hold about you and request that any inaccuracies be corrected.
Erasure (“Right to Be Forgotten”): Request deletion of your personal information when it is no longer necessary for the purposes for which it was collected, or when you withdraw consent.
